Privacy Policy:

Your privacy is vitally important to FilterTrader and your personally identifying information will never be disclosed for any reason whatsoever unless specifically required:

1) to resolve a technical issue with FilterTrader at your specific written request; or,
2) by FilterTrader’s payment processor to process your purchase of FilterTrader software or services; or,
3) to comply with a legal order.

FilterTrader will endeavor to protect your personal information to the greatest extent possible and will make commercial use only of demographic data that cannot be used to identify you (such as sex and age). By downloading or using FilterTrader software you agree to allow FilterTrader to send you email updates for the purpose of notifying you about new FilterTrader versions, new license information, and other FilterTrader or related trading information. These emails are mandatory to ensure customers are using the latest version and have the latest license.

However, FilterTrader respects your desire not to receive excess emails and will do everything possible to limit these emails to two or less per month. If you do not wish to receive OTHER promotional emails from FilterTrader, please notify us at: support@filtertrader.com. FilterTrader is British Columbia-based company and may be contacted at any time at: info@filtertrader.com. All such data above may be transferred to a third party in the event of acquisition of FilterTrader subject to that party honoring these terms in full.

You are welcome to link to the public pages of this site provided you permanently remove all links to this site within 2 business days if so requested by FilterTrader. Providing links to non-public or confidential portions of the site is strictly prohibited.

Risk Disclosure:

There is significant risk of loss when trading. Trading is not be suitable for everyone and you should carefully consider the risks in light of your financial condition when deciding whether to trade. Further, you alone assume the entire cost, loss and/or risk of any trading you choose to undertake. All funds committed should be purely risk capital. You may sustain a total loss of initial funds and any additional funds that you deposit in your account to establish or maintain a position.

You should realize that when trading you could lose the full balance of your account. Under no circumstances, including, but not limited to, accident or negligence, shall FilterTrader be liable for any special or consequential damages that result from the use of or the inability to use, the products, services, and information provided by this site or company. The products, services, and information provided on this site are not, and should not be construed as an offer or solicitation to buy or sell any securities or other named contracts or trading vehicles. Past performance is not an indication of future performance. No information provided by FilterTrader should lead you to believe that you will be profitable trading, with or without FilterTrader software and services.

FilterTrader Terms and Conditions:

1) You must be of legal age of majority in your place of residence.

2) Due to merchant account restrictions, and FilterTrader's products being irrecoverable electronic downloads, NO refunds can be provided for any reason after the 30-day trial period. Please be certain FilterTrader meets your needs during the free 30-day trial period.

3) You will not directly or indirectly copy, redistribute, make derivative works of, reverse compile, modify, "hack", commercially duplicate FilterTrader’s appearance or functionality, or commercially exploit or resell this program, its functionality, its trade secrets, or its data, in any way.

4) You understand and agree that FilterTrader and its affiliates are not a party to any trade which you may enter into using this software and you hold FilterTrader and its affiliates harmless for any trading problems you may have, whether caused by FilterTrader or not. FilterTrader and its affiliates do not provide trading, investment, execution, or custodial services or advice.

5) YOU RECOGNIZE THAT ALL PRODUCTS AND OTHER ITEMS PROVIDED TO YOU HEREUNDER ARE DELIVERED "AS IS." NO WARRANTIES ARE GIVEN, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF FITNESS FOR PARTICULAR PURPOSE OR MECHANTABILITY OR ARISING FROM A COURSE OF DEALING, USAGE OR TRADE PRACTICE. THE PRODUCT MAY POTENTIALLY BE PRONE TO ERRORS, DOWNTIME, CRASHES, FAULTS, AND DELAYED AND/OR ERRONEOUS DATA. TRADING WITH FILTERTRADER, AS WITH OTHER SOFTWARE, INVOLVES POTENTIAL RISK OF LOSS. YOU ASSUME THE ENTIRE RISK AS TO THE EFFECTIVENESS, QUALITY AND PERFORMANCE OF THE PRODUCT. IN NO EVENT WILL FILTERTRADER BE LIABLE FOR ANY SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, TRADING LOSSES, OR FOR ANY LIABILITY IN TORT, NEGLIGENCE, OR ANY OTHER LIABILITY INCURRED BY OR UNDER OR IN CONNECTION WITH THIS PRODUCT OR THIS AGREEMENT. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, FILTERTRADER DOES NOT WARRANT THAT THE USE OF THE PRODUCT, OR OF ANY INFORMATION CONTAINED IN OR RELATED TO THE PRODUCT, WILL NOT INFRINGE ANY PATENT, COPYRIGHT, TRADEMARK, OR INTELLECTUAL RIGHTS OF PERSON.YOU INDEMNIFY AND HOLD FILTERTRADER, ITS PARTNERS, DATA PROVIDERS, AND THEIR AFFILIATES COMPLETELY HARMLESS FOR ANY PROBLEMS, ERRORS, DELAYS, DOWNTIME, LACK OF NOTICE, LOSSES, OR CLAIMS AGAINST YOU AND OTHER LEGAL ISSUES RESULTING FROM YOUR TRADING OR USE OF THE SOFTWARE.  

6) FilterTrader utilizes certain technologies protected by international intellectual property law. You agree not to directly or indirectly assist in the violation of, or commercially exploit any copyright, patents, trade secrets, proprietary technology, and other intellectual property rights of the developer of FilterTrader, in your country or abroad, and you agree to not commercially utilize or lay claim to any intellectual property herein that you cannot prove on the date of this agreement was previously in the public domain or was previously owned and developed by you. You shall not directly or indirectly modify, reverse engineer, disassemble, reverse compile, distribute, rent, lease, assign, distribute or transfer the Product, nor shall you or your affiliates create any derivative works of the Product or commercially profit from the Product. To the extent that the Product includes runtime or other components licensed by FilterTrader from third parties, you and your affiliates shall not create any software program that links, embeds or makes direct function calls to such components. You and your affiliates shall not copy or assist in the copying of the Product IN ANY WAY. The Product, its data, and its associated intellectual property shall remain the exclusive property of FilterTrader or its Licensors, and FilterTrader reserves all rights not expressly granted to you. 

7) You agree not to reveal or disclose non-public FilterTrader documentation, data, or files (collectively referred to as information) to any third party, or permit any other party to access or utilize FilterTrader-related data.  Non-public information is information that is marked confidential, held on FilterTrader's file transfer protocol (FTP) site, or accessible normally by password access. FilterTrader-related data may not be copied or used outside the program for any purpose whatsoever.

8) Exchanges, regulators, brokers, or data vendors may change their policies relating to your use of this software at any time. You hold FilterTrader and its affiliates harmless for any consequences of such actions.

9) You understand that any information you obtain from this software, or FilterTrader or its affiliates, is not warranted for any purpose, and you will not rely on this information to make any decisions, financial-related, trading-related, or otherwise. Information and communications from FilterTrader and its associates are for informational purposes only. Claims of past or present performance, and stated software features, are absolutely no indication of your potential future success.

10) FilterTrader reserves the right to temporarily suspend your use of this software at any time for maintenance purposes, or permanently terminate your use if it suspects any breach of this Agreement, if it suspects fraud, or for unavoidable technical reasons.

11) Limited software support is provided to authorized users of paid FilterTrader versions. You must have the current version of FilterTrader installed to receive support. Please note that phone support is not provided for all FilterTrader versions. All issues related to trade execution, your trading account, or exchange operation must be directed to your broker and not FilterTrader.

12) FilterTrader's subscription license permits you to use FilterTrader on one PC only. If you wish to use FilterTrader on another PC you must purchase an additional license. You are allowed one free transfer of FilterTrader to another PC every four months. After this the regular subscription price applies also to the 2nd PC where FilterTrader is installed.

13) A valid FilterTrader license includes free regular upgrades for the duration of the license. Regular upgrades, including bug fixes, are provided at the sole discretion of FilterTrader. Premium versions, add-ons, and other services may be offered at an additional charge and regular FilterTrader licenses do not include usage rights for these additional products and services. Subscription fees paid for one version of FilterTrader are credited towards upgrades to premium versionse. Your FilterTrader subscription will automatically be renewed for another similar term unless you notify us at least five (5) business days prior to the expiry of your license. No further notice of renewals will be provided. You will be billed extra for tax only if we are required by law to collect it in our or your jurisdiction.

14) A free trial is available for you to test the software and make sure you are 100% happy with it before purchase. To reiterate from above, due to merchant account restrictions and the nature of FilterTrader's irrecoverable downloadable products, no refunds (full or partial) will be provided for any reason after the 30-day free trial period. To avoid credit card charges you must cancel BEFORE 30 days have elapsed from your free trial, or billing period. FilterTrader billing is automated so no cancellations can be provided retroactively.

15) All software and data prices, exchange fees, and the terms herein may be changed by FilterTrader at any time without notice. Price changes will take effect no sooner than the next billing cycle. A current copy of the terms and conditions is always available on this web page.

16) The validity, performance and construction of this Agreement shall be governed by the laws of British Columbia, Canada and you agree to submit to British Columbia’s exclusive legal jurisdiction and agree that any resulting judgments against you will be enforceable in your home territory. You agree that any claims against FilterTrader or you will be brought before relevant courts in British Columbia closest to FilterTrader’s headquarters. Failure by FilterTrader to enforce any terms of this agreement shall not be grounds for termination of this agreement, parts thereof, or for future breaches. You agree that a violation of any terms in sections 3 or 6 shall cause FilterTrader irreparable harm, and you agree to submit yourself to a court injunction and damages as brought by FilterTrader. Any language deemed invalid by an applicable British Columbia court shall be stricken from this agreement, with the rest of the agreement remaining in full force and effect.

17) This Agreement sets forth the entire understanding between the parties with respect to the matters set forth herein and supersedes all prior representations, understandings, or agreements, whether written or oral, express or implied, with respect to this transaction.

Additional Early Access Program (EAP) Terms and Conditions:

1) With respect to products, services, and information provided under FiterTrader's Early Access Program (EAP), the access period will begin upon the installation of the Product and may be terminated at any time, by either you or by FilterTrader, by providing email notification of such intent.

2) The duration of the access period, period ends on the date when the Product is announced by FilterTrader as being generally commercially available, upon notice by FilterTrader, or after 12 months from acceptance of this Agreement, whichever comes first.

3) FilterTrader solely determines the testers permitted in the EAP. You will not allow the product to be used by other users without the prior written consent of FilterTrader.

4) Upon any termination, Licensee shall cease all use and immediately destroy all copies of the Product, associated documentation, and all other materials or other confidential information provided by FilterTrader or obtained in connection with the EAP.

5) You understand that, in return for no-cost access to the software, your feedback about bugs and feature recommendations is important and appreciated.

If you do not understand and agree to all terms on this page do not install FilterTrader. If you have already installed it, do not log in and immediately and permanently erase the program from your computer.
